Collection of personal information 

SHIP2SHRED collects and uses personal information to understand your needs and interests and to serve you better. On some SHIP2SHRED websites, we ask you to provide personal information. For example, when you order our services, request information, subscribe to marketing or support materials, register yourself for SHIP2SHRED accounts, or apply for a job at SHIP2SHRED, we will ask you to provide personal information to complete these transactions. In addition to the information you provide, SHIP2SHRED may also collect information during your visit to an SHIP2SHRED website through our Automatic Data Collection Tools, which include Web beacons, cookies, embedded Web links, and other commonly used information-gathering tools. These tools collect certain standard information that your browser sends to our website such as your browser type and language, access times, and the address of the website from which you arrived at an SHIP2SHRED website. They may also collect information about your Internet Protocol (IP) address, clickstream behavior (i.e. the pages you view, the links you click, and other actions you take in connection with SHIP2SHRED websites) and product information. How we use your information

Credit card information is used only for payment processing and fraud prevention. Credit card information and other sensitive personal information required to process a credit decision is not used for any other purpose by our financial services providers or SHIP2SHRED and will not be kept longer than necessary for providing the services, unless you ask us to retain your credit card information for future purchases. 


How we share your information 

SHIP2SHRED,  or any of its subsidiaries will not sell, rent or lease your personal information to others. SHIP2SHRED shares personal information with companies working on our behalf and SHIP2SHRED-owned business entities. 

SHIP2SHRED retains service providers and suppliers to deliver complete products, services and customer solutions and to assist SHIP2SHRED with marketing and communication initiatives. Suppliers and service providers are required by contract to keep confidential the information received on behalf of SHIP2SHRED and may not use it for any purpose other than to carry out the services they are performing for SHIP2SHRED. 

If you choose to provide personal information only to SHIP2SHRED and not its marketing partners, SHIP2SHRED will not share this information with the other companies participating in that marketing initiative. Except as described in this Statement, SHIP2SHRED will not share the personal information you provide to SHIP2SHRED with any third parties without your permission, unless to: (i) respond to duly authorized information requests of governmental authorities; (ii) comply with any law, regulation, subpoena, or court order; (iii) help prevent fraud or to enforce or protect the rights and properties of SHIP2SHRED or its subsidiaries; or (iv) protect the personal safety of SHIP2SHRED employees and third parties on SHIP2SHRED property. 

Circumstances may arise where, whether for strategic or other business reasons, SHIP2SHRED decides to sell, buy, merge or otherwise reorganize businesses in some countries. Such a transaction may involve the disclosure of personal information to prospective or actual purchasers, or the receipt of it from sellers. It is SHIP2SHRED's practice to seek appropriate protection for information in these types of transactions. 


Credit Card Authorization Policy 

Like many companies that wait until after services have been rendered to bill its' customers, SHIP2SHRED reserves the right to pre-authorize a customer's credit card. Since SHIP2SHRED manages the pick-up and delivery of boxes for shipment that may have been inadvertently misjudged in size or weight upon the initial order, SHIP2SHRED must authorize its customers' credit cards based on the maximum size and weight amount for any given transaction. This ensures that SHIP2SHRED receives the appropriate financial compensation associated with the amount of materials picked up and destroyed.

Children's privacy 

SHIP2SHRED does not knowingly collect information from children under the age of 15 and does not target its websites to children under 15. We encourage parents and guardians to take an active role in their children's online activities and interests. 


Your choices and selecting your privacy preferences 

SHIP2SHRED gives you the choice of receiving a variety of information that complements our products and services. You can subscribe to receive certain product- and service-specific information and also choose to receive SHIP2SHRED general communications. We give you a choice regarding delivery of SHIP2SHRED general communications by postal mail, email and telephone. 

You can make or change your choices about receiving either subscription or general communications at the data collection point or by using other methods, which are listed in the following sections. This option does not apply to communications primarily for the purpose of administering order completion, contracts, support or other administrative and transactional notices. 

The email communications that you receive from SHIP2SHRED will be provided in accordance with this statement. 


Subscription communications 

Subscription communications include email newsletters, software updates, etc. that may be expressly requested by you. After you request such communications, you may opt out of receiving them by using one of the following methods:

• Select the email "opt out" or "unsubscribe" link, or follow the opt-out instructions included in each subscription communication.
• Return to the Web page(s) where you originally registered your preferences and follow the opt-out instructions.

Please be aware that when you opt out of receiving certain subscription communications, it may affect the services you have chosen to receive from SHIP2SHRED where accepting the communications is a condition of receiving the services. 


SHIP2SHRED general communications 

SHIP2SHRED general communications provide information about products, services, and/or support. This may include new product information, special offers, or invitations to participate in market research. 

SHIP2SHRED account registration is a single-login service that lets you register with SHIP2SHRED account-enabled websites using a single-user identifier and password of your choice. SHIP2SHRED accounts use cookies to store your basic personal information so you don't have to retype it when you return to one of SHIP2SHRED's many websites in the future. 


Access to and accuracy of your information 

SHIP2SHRED strives to keep your personal information accurately recorded. We have implemented technology, management processes and policies to help maintain data accuracy. SHIP2SHRED provides individuals with reasonable access to personal information that they provided to SHIP2SHRED and the ability to review and correct it, as applicable. To protect your privacy and security, we will also take reasonable steps to verify your identity, such as requiring a password and user ID, before granting access to your data. Keeping your information secure 

SHIP2SHRED takes personal privacy very seriously. To prevent unauthorized access or disclosure, to maintain data accuracy, and to ensure the appropriate use of the information, SHIP2SHRED utilizes appropriate physical, technical and administrative procedures to safeguard the information we collect. 

We use Secure Sockets Layer (SSL) encryption when collecting or transferring sensitive data such as credit card information. SSL encryption is designed to make the information unreadable by anyone but SHIP2SHRED. This security measure is working when you see the symbol of either an unbroken key or a closed lock (depending on your browser) at the bottom or top of your browser window. Credit card numbers are used only for processing payments and are NOT used for other purposes. As part of real-time payment processing, SHIP2SHRED subscribes to a fraud management service. This service gives you and SHIP2SHRED an extra level of security to guard against credit card fraud and to protect your financial data. 


Changes to this statement

Legal Terms

Limited Warranty. Customer agrees that SHIP2SHRED’s responsibility to Customer under this Agreement is limited to the exercise of ordinary care. EXCEPT AS PROVIDED IN THIS SECTION, SHIP2SHRED MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, NATURE OR DESCRIPTION, EXPRESS OR IMPLIED, WITH RESPECT TO ITS SERVICES, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND SHIP2SHRED HEREBY DISCLAIMS THE SAME. 


Limitation of Liability. In the event of any failure or delay in the performance of the services in accordance with this Agreement, SHIP2SHRED's liability shall be limited to the fee paid by Customer for the particular service. In no event shall SHIP2SHRED’s liability exceed an amount equal to the fees paid hereunder for the 12-months immediately prior to the date of Customer’s claim. In no event shall SHIP2SHRED be liable to Customer, whether in contract or in tort, or under any other legal theory (including, without limitation, negligence or strict liability) for lost profits or revenues, loss of use or similar economic loss, or for any indirect, special, incidental, consequential or similar damages arising out of or in connection with this Agreement or the services to be provided hereunder, or for any claim made against Customer by any other person, even if SHIP2SHRED has been advised of the possibility of such claim. Any insurance which may be carried by either SHIP2SHRED or Customer against any loss or damage shall be for the sole benefit of the party maintaining such insurance. 


Confidentiality. SHIP2SHRED will use commercially reasonable efforts to hold confidential all information obtained by it with respect to Customer and the Customer Materials. Security measures will be in place to reasonably ensure the security of the Customer Materials from the time SHIP2SHRED takes possession of the containers, during transfer and transport, until the Customer Materials are ultimately destroyed. 


Limitation of Actions. Any claim by Customer with respect to the services to be performed by SHIP2SHRED hereunder must be made in writing to SHIP2SHRED within 1 year after the date those facts underlying the such claim arose. No other action, regardless of form, arising out of or in connection with this Agreement (other than an action by SHIP2SHRED for any amount due to SHIP2SHRED) may be brought more than 1 year after the date those facts underlying the such claim arose. 


Indemnification. Customer shall defend, indemnify and hold harmless SHIP2SHRED and its officers, directors, employees and agents against any liability, cost or expense (including court costs and reasonable attorneys fees), other than bodily injury, irrespective of the theory on which any such claim is based (including, without limitation, negligence or strict liability), directly or indirectly arising out of third party claims, demands or actions relating to (a) SHIP2SHRED’s possession or destruction of Customer Materials, or (b) Customer’s breach of this Agreement, unless, in either case, caused by the gross negligence or willful misconduct of SHIP2SHRED. 


Force Majeure. SHIP2SHRED shall not be liable for any default or delay in the performance of any of its obligations under this Agreement if caused, directly or indirectly, by fire, flood, earthquake, the elements, or other such occurrences; labor disputes, strikes or lockouts; wars, riots or civil disorder; accidents or unavoidable casualties; interruptions of or delays in transportation or communications; decisions or requirements, whether valid, invalid, formal or informal, of any government, agency, board or official; or any other cause, similar to those enumerated herein, beyond SHIP2SHRED’s reasonable control. 


Miscellaneous. (a) Customer shall not assign all or any portion of this Agreement without the prior written consent of SHIP2SHRED. (b) No failure or delay by SHIP2SHRED to exercise any right or remedy hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or remedy by SHIP2SHRED preclude any further exercise thereof or the exercise of any other right or remedy. No express waiver by SHIP2SHRED to any breach of this Agreement shall constitute a waiver of any other prior or succeeding breach. (c) This Agreement shall be governed by the laws of the Province of Ontario, without regard to its principles of conflicts of law. (d) Headings describing the contents of particular sections are inserted only for convenience and shall not be construed as a part of this Agreement. (e) This Agreement and the Schedules attached supersede all prior discussions and agreements between the parties with respect to the subject matter hereof, and contains the sole and entire agreement between the parties with respect to the matters covered hereby. (f) This Agreement may not be modified or amended except by an instrument in writing signed by the parties. (g) If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remainder of the provisions hereof shall remain in full force and effect. (h) Except as otherwise provided in this Agreement, all notices under this Agreement shall be in writing and delivered personally or sent by pre-paid, first class, certified or registered air mail, return receipt requested, or by telecopy to the intended recipient at its address or telecopy number set out on the reverse side (or to such other address or telecopy number as a party may from time to time duly notify the other).
